Terms and Conditions of Sale

1. Introduction

These Terms and Conditions (“Terms”) apply to the sale of goods by Nuvoir Forged (“we”, “us”, or “our”) to you (“the Customer” or “you”).

By placing an order with us (accepting a quote and making payment), you agree to be bound by these Terms. Please read them carefully before confirming your order.

2. Basis of Contract

2.1. Quoting Process: As our products are bespoke and forged to specific requirements, we do not offer direct online purchasing. All sales are initiated via a request for a quote.

2.2. Not an Offer: A quotation issued by us does not constitute a legally binding offer. It is an invitation to treat.

2.3. Formation of Contract: A binding contract between you and Nuvoir Forged comes into existence only when:

  • (a) You accept our quote in writing or via email; AND

  • (b) We receive the required deposit or full payment as specified in the invoice; AND

  • (c) We send you a written Order Confirmation.

  • 2.4. Changes: Once the Order Confirmation has been sent and production has begun, changes to the specification (finish, offset, size, etc.) may not be possible or may incur significant additional costs.

3. The Goods (Custom & Bespoke Nature)

3.1. Bespoke Goods: Our forged wheels are manufactured to your specific requirements (custom offsets, finishes, bolt patterns, etc.). Therefore, they are classified as “Goods made to the consumer’s specifications” under UK law.

3.2. Fitment Responsibility: While we use our expertise to advise on fitment, it is ultimately your responsibility to ensure that the vehicle data (Make, Model, Year, Brake Modifications, Suspension Modifications) provided to us is accurate. We accept no liability for wheels that do not fit due to incorrect or incomplete information provided by you.

3.3. Finishes: Images on our website are for illustrative purposes. As finishes are often hand-applied or subject to batch variations in anodizing/powder coating, the actual colour and finish of the Goods may vary slightly from the digital images.

4. Price and Payment

4.1. Currency: All prices are quoted in GBP (£) Sterling.

4.2. VAT: For UK customers, VAT is included at the current applicable rate. For international customers, VAT may be removed, but you are responsible for your local taxes (see Clause 6).

4.3. Payment Terms:

  • Unless otherwise agreed in writing, a non-refundable deposit of 50% is required to commence production.

  • The remaining balance must be paid in full prior to the dispatch of the Goods.

  • We accept payment via Bank Transfer / Card Payment.

  • 4.4. Price Validity: Quotes are valid for 30 days from the date of issue, after which we reserve the right to adjust prices.

5. Production and Delivery

5.1. Lead Times: Any manufacturing or delivery dates provided are estimates only. Custom forged wheels involve complex manufacturing processes. While we strive to meet target dates, time is not of the essence of the contract, and we are not liable for delays caused by manufacturing complexities, third-party shipping delays, or force majeure.

5.2. Shipping: We will arrange delivery to the address provided by you.

5.3. Risk: Risk in the Goods passes to you once they are delivered to the address provided.

5.4. Inspection: You must inspect the Goods immediately upon arrival. If the packaging is damaged, you must sign for it as “Damaged” and notify us within 48 hours.

6. International Orders (Import Duties)

6.1. If you order Goods for delivery outside the United Kingdom, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination.

6.2. You are responsible for payment of any such import duties and taxes. We have no control over these charges and cannot predict their amount.

6.3. We will not be liable for any breach of laws in the country of destination.

7. Returns and Cancellations

7.1. IMPORTANT: NO RIGHT TO CANCEL Under the Consumer Contracts Regulations 2013, the standard 14-day “cooling-off” period DOES NOT APPLY to goods that are made to the consumer’s specifications or are clearly personalised.

  • As Nuvoir Forged wheels are custom manufactured to your specific order, you do not have the right to cancel the contract or return the goods simply because you have changed your mind.

7.2. Cancellation by Customer: If you attempt to cancel an order after production has commenced, you will be liable for the full cost of the work completed up to that point, which generally means the forfeiture of your deposit.

7.3. Defective Goods: This clause does not affect your statutory rights regarding faulty or misdescribed goods. If the wheels are structurally defective or the finish is not as described (subject to Clause 3.3), please contact us immediately. We reserve the right to inspect the goods and, at our discretion, repair or replace them.

8. Warranty

8.1. We provide a limited warranty on our forged wheels as follows:

  • Structural Warranty: 5 year warranty against structural defects under normal road use.

  • Finish Warranty: 1 Year warranty on paint/powder coat finishes against peeling or lifting.

8.2. Exclusions: The warranty does not cover:

  • Damage caused by potholes, kerbing, or road hazards.

  • Damage caused by improper installation (e.g., using wrong lug nuts or torque settings).

  • Wheels that have been modified, repaired, or altered by a third party.

  • Corrosion due to neglect or use of harsh chemicals/acidic wheel cleaners.

  • Racing or track use (unless explicitly agreed in writing).

9. Limitation of Liability

9.1. Nothing in these Terms limits our liability for death or personal injury caused by our negligence.

9.2. Subject to 9.1, we are not responsible for:

  • Indirect or consequential losses (e.g., loss of earnings, loss of vehicle use).

  • Costs of fitting, removing, or balancing wheels.

10. Intellectual Property

All designs, trademarks, images, and content on the Nuvoir Forged website and in our marketing materials are the intellectual property of Nuvoir Forged. You may not use, reproduce, or distribute them without our prior written consent.

11. Governing Law

These Terms and any dispute or claim arising out of them shall be governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
